Meeting the changing needs of children with child support

Most people are familiar with the legal concept of res judicata, which prevents parties to the same litigation from re-litigating the same issues in hopes of obtaining a more favorable result. While the concept of res judicata has some application to child custody and support, Virginia’s lawmakers rightfully allow the parents to seek modification of existing child support orders whenever a parent can demonstrate a material change of circumstances that justifies a modification. This flexibility allows the court system to address the changing needs of the child as well as the changing abilities of parents to pay support. […]
